ESS guarantees the user limited access, in personal interest (making online orders, information), on the website www.essence-du-fragrance.ro and does not grant him the right to download or modify the website partially or fully, to partially or fully reproduce the site, to copy, sell/resell or exploit the site in any other way, for commercial purposes or contrary to the interests of the ESS company without its prior written consent.

The use of the website www.essence-du-fragrance.ro is allowed only within the limits mentioned in this document.

2. The products and services offered by ESS on the website www.essence-du-fragrance.ro, price policy
ESS reserves the right to select its clients. The products sold through www.essence-du-fragrance.ro are new, in the original packaging and at the time of delivery are accompanied by the tax invoice, according to the legislation in force. The products and services are offered in compliance with the provisions of this document and within the limits of the available stock. 
The prices shown include all applicable taxes and do not include delivery costs, unless expressly specified on the website. 
An order is considered accepted and taken after telephone confirmation with one of our operators.
ESS reserves the right to modify the technical specifications of the products without prior notification.

3. Payment of products
Payment for the products ordered from the website www.essence-du-fragrance.ro can be made upon delivery of the products by courier (cash on delivery) or in advance. Advance payment can be made by bank card. In the case of advance payment, the delivery will be made only after the money has entered the ESS account. The ordered products must be paid in full, otherwise the delivery will not be made.
ESS reserves the right to request payment of products in advance in certain cases.

4. Delivery of products
The products are delivered anywhere in the country (Romania), through the fast courier company Bookurier and TNT Romania.
The DELIVERY TERM of the products is between 7 and 10 working days. To see how long it takes for a product to reach you, check the delivery time with a representative of www.essence-du-fragrance.ro. 
Delivery costs are:
– FREE OF CHARGE for orders whose value exceeds 350 RON 
– 20 RON with VAT included for orders with a value between 0 and 349 RON
If the customer is not found at the mentioned address, he will be contacted by phone by the courier company.
The receipt of the products represents the customer's acceptance that the products have arrived in good condition. The invoice constitutes the sale/purchase contract according to the Romanian legislation in force. The customer expresses his explicit agreement when signing the invoice regarding the fact that he received the product(s) that is (are) in accordance with the order and his needs.
ESS reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons beyond ESS's control, which include: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances or other force majeure impediments according to Romanian law.

The maximum amount of damages that can be paid by ESS to any customer in case of non-delivery or improper delivery is the amount collected by ESS from this customer.

5. Information about the RETURN of purchased products
The customer can unilaterally terminate the contract with www.essence-du-fragrance.ro without citing a reason, within 14 calendar days (according to art. 9 of GEO 34 of June 4, 2014 regarding the legal regime of distance contracts, only in writing and can return the product(s) within the same period of 14 days.
Thus, the products bought on www.essence-du-fragrance.ro can be returned according to the law, within 14 working days from their receipt by courier.
Before returning the product, it is mandatory to announce by email (office@essence-du-fragrance.ro) the intention to return a product/several products.
The product will be returned in the same condition in which it was delivered, i.e. new and in the box, together with all the accessories related to the product, unworn, without stains or tears. Otherwise, it can be reshipped to the customer.
Also, NOT products with physical changes, broken or forced seams, dirt, etc. are accepted for return. The products must be returned by fast courier in the DOOR TO DOOR system. The return of the products will be made at the customer's expense.

PARCELS WITH REFUND PAYMENT ARE NOT ACCEPTED, THEY WILL BE RETURNED AGAIN TO THE SENDER! PRODUCTS SENT BY ROMANIAN POST ARE NOT ACCEPTED.

Products can be returned without citing any reason. 
www.essence-du-fragrance.ro will refund the value of the products in no more than 14 days from the date of receipt of the return. The refunded amount does not include shipping costs.

!!!Products that are exempt from the exercise of the right of return:
According to article 16 of the Emergency Ordinance no. 34/2014, are exempted from the right of withdrawal:
- Products made according to the specifications presented by the consumer or clearly customized;
- Products unsealed by the consumer whose new marketing could present risks for reasons of hygiene or health protection for other consumers.


6. Product warranty 
All products sold by www.essence-du-fragrance.ro benefit, based on the invoice, from a commercial guarantee period of 30 calendar days, calculated from the moment of receipt of the package.
When requesting the guarantee, it is necessary to present the defective product in the original packaging, together with the related accessories, a copy of the tax invoice and the original guarantee certificate (if applicable). If proof of these documents is not provided, the products can be returned to the applicant/shipper without voiding the warranty.
In case of a complaint, www.essence-du-fragrance.ro can repair the product or replace the product, if it is available in stock. If it is not available, the customer will be reimbursed the purchase price within the time period stipulated by law calculated from the date of receipt of the written complaint and the product in question.

Ways of securing the guarantee:
– Product repair;
– Replacement of the product – if it cannot be repaired;
- Reduction from the initial value - depending on the nature of the deficiencies presented;
- Return of the product value, if neither repair nor replacement is possible.
Conditions in which the warranty becomes inapplicable or void
- moral wear or normal physical wear and tear of the product;
- discoloration of the product or some component parts following exposure to severe environmental factors (sources of heat and/or humidity);
- defects caused by improper or abusive use;
- intervention, repair or modification made by unauthorized persons;
- damage to the product caused, voluntarily or involuntarily, by shocks associated with breaking, hooking, hitting or scratching the good;
- defective maintenance.

ESS will not bear the responsibility nor will it be liable for any kind of compensation for any kind of damages caused by such comments or electronic communications, they being offered under the same limitation of responsibility as the rest of the content on the website, according to the articles of this document. In case of sending information, other than those related to the process of buying/selling some products, it is considered that the user grants the ESS company and its partners the non-exclusive, unlimited, free, irrevocable and retransmissible right to use, reproduce, modify, adapt, publish, translate, as well as the right to distribute it through any media anywhere.

9. Final Provisions
Any other problem caused by the products and services presented on www.essence-du-fragrance.ro and which is not already covered by any article in this document, will be resolved amicably within 30 working days from the date of notification in writing of the problems, by the user.

If the conflict was not resolved amicably, the competence rests with the Romanian courts or an alternative dispute resolution body agreed by both parties.
